1. Acceptance of Terms

By downloading, installing, or using BitFX Wallet ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and BitFX Technologies Inc. ("Company," "we," "us," or "our") regarding your use of BitFX Wallet.

2. Description of Service

BitFX Wallet is a non-custodial, multi-chain cryptocurrency wallet that allows you to:

• Store, send, and receive digital assets across multiple blockchain networks
• Interact with decentralized applications (dApps)
• Stake supported cryptocurrencies
• Swap tokens through integrated decentralized exchanges
• Access fiat on/off-ramp services through third-party providers

3. Non-Custodial Nature

3.1 Your Responsibility

BitFX Wallet is a non-custodial wallet, meaning:

• You have sole control and responsibility for your private keys and seed phrases
• We cannot access, recover, or reset your private keys or seed phrases
• Loss of your private keys or seed phrases will result in permanent loss of access to your digital assets
• You are responsible for keeping your private keys and seed phrases secure and confidential

3.2 No Recovery Services

We do not provide private key or seed phrase recovery services. If you lose access to your private keys or seed phrases, we cannot help you recover your digital assets.

4. Supported Assets and Networks

BitFX Wallet currently supports assets on the following blockchain networks:

• Ethereum
• Base
• Solana
• Bitcoin (planned)

We may add or remove support for specific assets or networks at any time without prior notice.

5. User Responsibilities

By using BitFX Wallet, you agree to:

• Use the App in compliance with all applicable laws and regulations
• Not use the App for any illegal or fraudulent activities
• Keep your device and App updated with the latest security patches
• Not attempt to reverse engineer, hack, or compromise the App's security
• Verify all transaction details before confirming transactions
• Understand the risks associated with cryptocurrency transactions

6. Risks and Disclaimers

6.1 Cryptocurrency Risks

You acknowledge and accept the following risks:

• Cryptocurrency values are highly volatile and can result in significant losses
• Blockchain transactions are irreversible
• Network congestion may cause delays or increased fees
• Smart contract vulnerabilities may exist in dApps you interact with
• Regulatory changes may affect the availability or legality of certain features

6.2 Technical Risks

• Software bugs or vulnerabilities may exist
• Internet connectivity issues may prevent access to your wallet
• Mobile device security compromises may expose your private keys
• Third-party service integrations may fail or become unavailable

7. Third-Party Services

BitFX Wallet integrates with various third-party services including:

• Decentralized exchanges (DEXs) for token swaps
• Fiat on/off-ramp providers (MoonPay, Transak, etc.)
• Blockchain node providers
• Price data providers
• DeFi protocols for staking

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or performance of these third-party services.

8. Fees

While BitFX Wallet itself is free to use, you may incur fees from:

• Blockchain network transaction fees (gas fees)
• Third-party service provider fees
• DEX trading fees
• Fiat on/off-ramp provider fees

These fees are set by the respective networks and service providers, not by us.

9. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your information.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD
• WE ARE NOT LIABLE FOR LOSSES RESULTING FROM YOUR FAILURE TO SECURE YOUR PRIVATE KEYS
• WE ARE NOT LIABLE FOR THIRD-PARTY SERVICE FAILURES OR BLOCKCHAIN NETWORK ISSUES

11. Indemnification

You agree to indemnify, defend, and hold harmless BitFX Technologies Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any applicable laws
• Any third-party claims related to your use of the App

12. Termination

You may stop using the App at any time. We may suspend or terminate your access to the App if we believe you have violated these Terms or for any other reason at our discretion.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
